Military Court: Andrie Yunus Case Could Be Rejected by Civil Court

TEMPO.CO, Jakarta – The Military Court II-08 Jakarta has received the case dossier on the acid attack against Andrie Yunus, which was transferred by the Military Prosecutor’s Office II-07 Jakarta.

The head of the court, Colonel Fredy Ferdian Isnartanto, said the institution has both absolute and relative jurisdiction to try the case.

“If this were handled in a civilian court, it would not be appropriate and the legal process would not proceed. It could even be rejected by the district court,” Fredy said at a press conference at the Military Court II-08 Jakarta on Thursday, April 16, 2026.

He said the four defendants in the case are members of the Indonesian National Armed Forces (TNI), giving the military court absolute jurisdiction to hear the case.

He added that the incident occurred on March 12 on Salemba Street, Central Jakarta, placing the case within the court’s territorial jurisdiction.

“The locus of the case falls under the jurisdiction of the Jakarta Military Court,” he said.

Fredy also said jurisdiction is appropriate based on rank. The defendants are identified as Captain NDP, First Lieutenant BHW, First Lieutenant SL, and Second Sergeant ES. “Cases involving officers fall under the High Military Court II Jakarta. So I can confirm this is within our authority,” he said.

Previously, the Advocacy Team for Democracy (TAUD), legal counsel for Andrie Yunus, urged the Military Court II-07 Jakarta to reject the dossier from the Military Prosecutor’s Office II-07 Jakarta.

TAUD said the case file was compiled without transparency and accountability, and did not meet standards of justice for the victim.

TAUD representative Muhammad Isnur said Andrie had not received official updates on the investigation from either the Military Prosecutor’s Office or the TNI Military Police Center (Puspom TNI).

He also said the victim objected to the case being tried in a military court, calling it a “sanctuary for impunity.”

Isnur alleged that the rapid transfer of the case to military court was an attempt to shield those behind the attack, obscure facts, and avoid public scrutiny. He said only four individuals have been named as suspects, while TAUD’s findings suggest at least 16 people were involved in the incident.

“This transfer further demonstrates efforts to create impunity for TNI personnel involved in ordinary crimes,” he said.

Isnur also said that TAUD’s report to the Criminal Investigation Unit of the National Police has been forwarded to the Jakarta Metropolitan Police. He therefore urged the Military Court II-07 Jakarta to reject or delay acceptance of the case dossier.

TAUD also called on President Prabowo Subianto to instruct the Military Prosecutor’s Office II-07 Jakarta to return the case to the Jakarta Metropolitan Police for prosecution in civilian court.

“The determination of jurisdiction should not be based solely on the perpetrators’ military status, but on the nature of the crime and its relation to official duties,” Isnur said.
