Tom Lembong on Court's Verdict: "No Mens Rea"

TEMPO.CO, Jakarta - The Central Jakarta District Court has sentenced Thomas Trikasih Lembong, or Tom Lembong, who served as Trade Minister from 2015 to 2016, to four years and six months in prison. He was also ordered to pay a fine of Rp750 million, or face an additional six months in prison.

Following the verdict at the Central Jakarta District Court on Tuesday, July 18, 2025, Lembong commented on the outcome.

"The first and most important thing is that the panel of judges did not state any malicious intent on my part, no mens rea," he asserted.

He clarified that this means the judges did not allege any conscious intent to commit a crime on his part, and thus the verdict was not based on such a finding.

Lembong also found the judge's verdict peculiar, as he believes it disregarded his authority as a minister. "The panel overruled my authority as Trade Minister," he stated. "I think the law clearly mandates the Trade Minister to regulate governance, including trade and commerce in basic commodities."

He further added, "The panel's verdict is like copy-pasting," suggesting, based on his previous statement, that the panel had overlooked key facts presented during the trial.

When asked about a potential appeal, Lembong responded, "Of course, the regulations give us as defendants seven days to decide our next steps, after consulting with our legal advisors."

Tom Lembong was found guilty of violating Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Corruption, as amended by Law Number 20 of 2001, in conjunction with Article 55 paragraph (1) point 1 of the Criminal Code.
