Tom Lembong Reports Auditor Who Calculated State Losses of Rp578 Billion

TEMPO.CO, Jakarta - Indonesia's Former Trade Minister Tom Lembong reported the auditor who handled state financial losses in the sugar import corruption case at the Ministry of Trade during the 2015-2016 period. The report was submitted to the Financial and Development Supervisory Agency (BPKP) and the Ombudsman.

"So we have sent a team there (Ombudsman and BPKP) to also make a report," said Tom's legal advisor, Zaid Mushafi, to the media at the Judicial Commission Building on Monday, August 4, 2025.

Today, Tom Lembong's legal advisors visited several institutions to make a report. Initially, they went to the Supreme Court, then to the Judicial Commission, to report the panel of judges of the Jakarta Anti-Corruption Court on alleged violations of the code of ethics. They also made a report to the Ombudsman and BPKP. "If Ombudsman and BPKP are related to financial audits," said Zaid. He accused that the state's financial losses audit by BPKP auditors was not conducted professionally.

Zaid did not explicitly mention who the BPKP auditors reported by Tom Lembong were. However, he mentioned the name Chusnul Khotimah as the head of the team.

In the case of sugar import corruption during the 2015-2016 periode, the public prosecutor charged Tom Lembong with causing state financial losses amounting to Rp578,105,411,622.47 or Rp578.1 billion. This figure was based on the BPKP audit.

Quoted from Tom Lembong's indictment letter, the state financial loss in the sugar import corruption case amounts to Rp578.1 billion. The loss comes from two things, namely:

1. The excessive price paid by PT Perusahaan Perdagangan Indonesia (Persero) in the procurement of white crystal sugar for price stabilization assignment or market operation amounted to Rp 194.71 billion;

2. Shortfall in customs duties and taxes in the import amounting to Rp 383.38 billion.

The panel of judges of the Jakarta Anti-Corruption Court in their ruling stated that the state financial losses in the sugar import corruption case of Tom Lembong were only Rp 194.71 billion. Not over half a trillion as alleged by the prosecutor.

The judges disregarded the calculation of the customs duties and taxes shortfall in the import. Because, this component could not be accurately and concretely calculated.

Furthermore, Zaid highlighted the consideration of the panel of judges. The judges did not use the BPKP audit results as a whole. According to him, this is also evidence that the agency's audit was not carried out professionally.

"One of the keys to imprisoning Mr. Tom Lembong is the BPKP audit which stated that state financial losses had occurred," said Zaid. "What if this happened to the current or former ministers?"

He stressed that this report was not intended to undermine the BPKP institution. Rather, it is for correction so that there will be no audit processes like the one experienced by Tom Lembong in the future.

Previously, a man named Thomas Trikasih Lembong was found guilty of committing sugar import corruption by the Jakarta Anti-Corruption Court. He was sentenced to 4 years and 6 months in prison, and a fine of Rp 750 million or an additional 6 months of imprisonment.

Tom Lembong's fate changed after he received clemency from Indonesian President Prabowo Subianto. He was eventually released from the Cipinang State Detention Center, East Jakarta on Friday, August 1.
