Febrie Adriansyah's Lawyer Says Judge Did Not Rule He Received Rp40 Billion

TEMPO.CO, Jakarta Febri Diansyah, the lawyer for Febrie Adriansyah—the former Junior Attorney General for Special Crimes at the Attorney General's Office—clarified that the narrative suggesting the pretrial hearing judge ruled his client received Rp40 billion from conglomerate Tan Kian is incorrect.

"The information has been taken out of context, creating the impression that the judge ruled or stated that Mr. FA received Rp40 billion," Febri said in a written statement on Saturday, August 28, 2026. He emphasized that the legal team had reviewed the hearing transcript. "It is untrue that the pretrial judge reached such a conclusion."

He explained that, in reality, the pretrial judge noted the existence of evidence—specifically the official investigation record (BAP) or excerpts of testimony from Tan Kian—submitted by the respondent during the pretrial proceedings. This matter came to light during the ruling hearing for pretrial case number 134/Pid.Pra/2026/PN JKT.SEL on Thursday, August 28, 2026.

In the case, the Special Criminal Investigation Directorate of the Jakarta Metropolitan Police is named as the first respondent, while the Corruption Eradication Corps of the Indonesian National Police is the second respondent. Meanwhile, the Directorate of Investigation under the Junior Attorney General for Special Crimes (Jampidsus) at the Attorney General's Office is named as an interested party (turut termohon). "The evidence shows Tan Kian handing money to an individual named Ferry. There is absolutely no mention of Tan Kian giving money to FA," Febri continued.

He cited the court's reasoning, noting that the pretrial judge could not determine whether or not his client had received the money. Thus, Febri argued, it was merely a one-sided admission by Tan Kian. "We want to clarify this: the judge never made such a statement or conclusion," said the former spokesperson for the Corruption Eradication Commission (KPK). "In fact, the judge explicitly stated that no conclusion was drawn because the matter falls within the scope of the case's merits."

Febri Diansyah stated that the matter regarding the handover of funds should be examined during the main trial. He also urged the public to exercise caution when receiving information.

Judge's Considerations Regarding Tan Kian's Testimony

Sole Judge Richard Edwin Basoeki of the South Jakarta District Court read out the considerations behind the decision to reject the pretrial motion filed by Febrie Adriansyah. One of these considerations concerned the testimony of Tan Kian, the founder of Century Properties Group.

"Considering that one of the statements cited as part of the evidentiary framework is the testimony of Tan Kian regarding the handover of funds—in Singapore dollars equivalent to Rp40 billion—to the petitioner (Febrie Adriansyah), which, according to said testimony, was related to the Jiwasraya and/or Asabri legal cases," the judge stated on the evening of Thursday, August 27, 2026, at the South Jakarta District Court.

The judge then cited statements from investigators indicating that the account of the Rp40 billion handover (in Singapore dollars) was consistent with documentary evidence as well as transaction and communication data. According to the judge, the witness's testimony constituted sufficient preliminary evidence as stipulated in Article 235, Paragraph 1 of Law Number 20 of 2025 concerning the Criminal Procedure Code.

However, he stated that a pretrial judge cannot examine the veracity of Tan Kian's testimony. "Considering that in a pretrial proceeding, a judge is not authorized to extend the examination to determine whether Tan Kian's testimony is true, whether the money was actually received by the petitioner, whether the transfer constituted bribery or extortion, or for whom the money was intended. Such an assessment would amount to adjudicating the elements of the criminal offense itself," said Judge Richard.
